Is spamming really that illegal?

I've heard of spamming being illegal (specifically email blasts). But are other types of spam illegal? Like making fake facebook account? Fake yahoo accounts and using them to promote affiliate programs? (or I suppose in order to appease my affiliate programs I would have to link to my website and then that links back to the affiliate program).

What do you guys think? Like using proxies to create the facebook accounts isn't an issue. But for the affiliate, I'm would have to use all my real information wouldn't I? In order to get paid? And then wouldnt it be easily tracked back to you? Or is it not as illegal as I've heard?

If creating fake Facebook accounts was illegal then I would have already been behind bars before 2 years. Till now, they would have already hanged me to death for creating those many fake FB accounts and spamming them.

No! Creating Fake FB accounts isn't illegal (but it's against their T&C). But, who cares.

Yes, it's illegal at least in the US. If you're interested in reading more about it look up the CAN-SPAM Act.
 
Never heard of making a fake FB account being illegal. That would seriously be the funniest joke I've heard all day. Actually in my whole life.
 
Check the CAN-SPAM act, if you are in the US. It's also illegal in many other countries, including EU countries. Basically you are not allowed to send any market-emails unless the receiver have authorized you to do so (opted in somehow). Regarding FB accounts - no, it's not illegal. It's simply against their Terms of service
 
Ohh ok :) Scared me there for a minute. But yeah I figured email spam was illegal as I remember a couple years ago hearing about these people/persons getting arrested who were responsible for like 30% of the spam in the world, or something like that. I was just really curious about all this because I find it strange that email spam is illegal, but spamming on Facebook, blogs, and other sites are not.
 
If you're not from US, you can spam how much you want and who you want :) Don't worry, i know some US spammers aswell that spam like hell and so far so good.
 
Making Fake Fb account is not illegal base in cyber world.. Ive done many fake accounts since 2010 and never get caught until now.. :)
 
If making fake FB/gmail/yahoo/twitter accounts was illegal, then half of BHW would be in prison already
 
If spamming is illegal, do not be surprised if one day I disappear from here for a few years. Spamming is my life, but you know what really irritates me, when little c**ts spam my websites, especially my games one were 100's of people sign up a day to tell everyone how to get a bigger bellend.

Registering a fake FB profile is illegal in my country. And the trace is usually used by the phone no that you use to verify your account. The same applies to anything that have a social exposure. Personal email is not illegal if you register with a fake profile.
 
Spammimg is illegal.

There are several areas of Law, including Criminal, Contract and Civil.

Email Spam is Criminal because laws have been passed.

Breaking ToS for YT or FaceBook may fall under Contract and Civil Law depending on the Jurisdiction.
It would be considered a Civil Matter because any prosecution would be made by the Company involved and not the Government.
 
If you start thinking like this then you will not be successful in IM.
 
I get so furious whenever I read so much mis-information. EMAIL SPAMMING IS NOT ILLEGAL. There are some laws you must abide by. You must give them an option to opt out. You must clearly describe the email as a marketing effort. You must use your real contact information.

So many people in here quoting the CAN-SPAM act and they've never read it! ARRRRRGH!

So judging by the amount of spam in my inbox every morning if mass email was illegal we'd see 100 death penalties each day.....

It may be illegal in the USA or Europe, but obviously the big spammers are working offshore.
