is it normal to get labeled as "probable spam" for newly created user's comment?

I tend to pop-up from time to time so that could be it.
It's a bit of both, mostly plain old checking how long it usually takes other users who complain about the label thing. Data might be skewed one way or the other, but it's a good guesstimate.
