Is DMCA-Ignored Hosting Illegal In 2024?

I'm curious about the legality of DMCA-ignored hosting. With many hosting providers operating in jurisdictions that don't enforce DMCA takedown notices, it's become a popular choice for those seeking greater content freedom. I'm aware there are potential legal risks involved, especially concerning international copyright laws. Can anyone shed light on whether DMCA-ignored hosting is considered illegal, and what the implications might be for users and providers? Are there specific countries or circumstances where this type of hosting might still lead to legal trouble? Looking forward to insights and experiences from the community!

no its not illlegal. DMCA is actually ONLY a U.S. law.
no web host, outside U.S. should accept DMCA if they do not have servers/offices located in U.S. But still many web hosts in EU, Asia, Australia accept DMCA and that is actually illegal. You can't enforce other country's law in your country. You can actuallly enforce your local country laws (copyright infringement) which can be better or not better than DMCA.

That's why I prefer to host with companies which are truly dmca ignored. that is they discad dmca notices, but yes, if they receive court order from their local country (where server is hosted) then only they have to take specific content down.

DMCA is actually void outside USA. if you find content stolen, file a proper take down notice in according to law of the country of the host.

What major (and fake) dmca ignored hosting companies do is marketing as as fully dmca ignored but will take down your entire site if they receive a lawyer letter/subpoena.

update: if you are asking as a web host, then dmca-ignored content can be uploaded to any EU country, Asian country, and you've to abide local copyrigth laws. Some users/customers think dmca ignored means full immunity, but that is not actaully.

this is because people don't use the "counter notice" feature in dmca when they receive dmca.
if you either have copyright (or not) and you receive dmca notice and if you are non-U.S. resident, and file a counter notice, that you own the content, then the original copyright holder has to go to U.S. court and sent the web host a subpoena/order/lawyer letter that content should be taken down, if not, in 14 days, the web host or you (infringer) can reupload the content.

How many of people have used this? Do you think except the big corporations like Disney or Fox Sports, etc, are going to court? Nopes. then just file/send a counter notice to copyright holder and sit back. they'll not go in the court. or will they?

Excellent explanation.
DCMA is US law like GDPR is EU.
No one will host anything which attract DMCA. Forget about hosting now a days simple letter to domain registrar can suspend the domain.
 
If you host a site which is legal in your country using a DMCA ignored provider, you will not run in your problem, but if you run a site which could be considered illegal in your country using a DMCA ignored provider it still illegal^^

Yes, technically, it's illegal in US Law. However, some countries in Europe and Asia, like the Netherlands, Germany, and Hong Kong, allow websites to ignore copyright takedown requests. If used to share pirated content, it's illegal. Always ensure your activities follow the law to avoid trouble.

As I already told you, some countries do not follow DMCA rules; here, the provider I Already Checked has a Netherlands location, which is Fully DMCA Free and has advanced Security for your Pirated or Copyright product, whether it is a Movie, APK or duplicate Watch of top brands. yes if you are looking for dmca server then you can go with it as they are having Netherlands location which is dmca free.

Also there are many more option too abelohost and shinjiru too.
 
I would think outside the box and host it somehow in my house maybe. Just connect that to some 3rd party unabused IPs.
But what's the matter if DMCA takedowns happen on all US sites?
I don't know what's the point of that.

They may not take down your site, but they'll take down it from SERPs and other places.

Really? But you must have a valid reason so they accept to suspend someones domain, it's a serious thing. Do you have experience with this?
