Infraction can't open BST ?

I tried searching the forum, i see a few mixed answers.

Is it true that I can't open a BST thread if I'm under an infraction ?

I just got one yesterday :(

  1. You must be free from bans and infractions (subject to moderator approval).
So even with infraction you can try to open a BST and if it's nothing related you might get approved?
 
if have say an infraction that lasts for say 3 months
my understanding is - u cant apply until the infraction has
expired
