Incentive on Non Incentive

Hope you are well.

Just a slight concern that has run my mind, our clients have been running some CPA offers on Incentive traffic when we should not have been, they are Non Incentive offers. I looked into what the possible consequences are but i cannot find a straight answer.

I wanted to ask what is the worst that can happen if the Merchant finds out please. Can they close our account and terminate any payments? Is this activity illegal could we be prosecuted, so far i have not found any prosecutions in this area and am not sure if this is illegal or just a breach of the affiliates Terms and Conditions. Could they take civil action? If someone would please clarify this it would be appreciated, the main reason for asking is should we continue with this activity or seize it really? We do work with Email, Display and other traffic but we have been quite lazy in eliminating this activity.

Does everyone agree running Incent on Non Incentive offers is just Black Hat and unethical activity? If anyone knows more about the laws, please i would be grateful for your input.

Is there no laws for Incent on Non Incent yet so would it not be a criminal offence? Would it just be a breach of an Networks Terms of Service? Is it correct the worst case scenrario would be that we could lose all commissions?

What about running Incent to an Adsense banner from Google, would this just be unethical?

It's against the rules, not against the law. You're more likely to be a victim of account termination than legal prosecution.

So what if any legal prosecutions can be brought in a worst case scenario please? If its not against the law i am taking this cannot go to criminal court.

It really depends how these merchants would take such a thing, what do their terms of service indicate?
