This is a gross mis-characterization of black hat SEO. While it can entail things such as "hacking" (infecting sites with malware, etc), that isn't the "basic" definition. Hacking is generally illegal. Black hat is simply anything that goes against the TOS of the major search engines. Buying links is black hat, but still legal. Building a PBN is black hat, but still legal. Using bots to blast views, and interactions is black hat, but still legal.
