I owe Ebay 1000eu

Hi guys,

New here. Have a problem with ebay. Here is the case if anyone can provide come help:

I sold a saxophone, and put it down as used but in description I wrote "like brand new, new pad, plays like butter". Now the buyer made a case saying item not as described. He said the sax is broken (which it isn't), and said it's full of scratches (which it is). However I listed it as used, which says the item can have scratches. When the money went in my paypal account, I put them straight to my bank so I have the money. The problem is my dad's bank account is on paypal, and some of the money was sent there. Now ebay told the buyer to ship the saxophone back to me to check it's condition, and if it's as I sent it, I have to refund 1000euro! I have spent the money on my bills, and I don't have any money to pay him. My paypal is -1000euro right now. I'm scarred that they could take the money from my dad's credit card since it's on paypal.

I thought about closing my bank account and tell them to f*** off, but my dad can't close his account cause he has loans to pay and an overdraft that they won't give him with a new account now.

Moreover, I fought with eBay about this situation and they seem to not care one bit.
I'm wondering, what happens if I don't refund the guy? I know that ebay will refund him, and then ask money from me. But what happens if I don't pay them? I live in Cyprus btw, a small EU island. And could they just take the money out of my dad's card? Isn't that illegal?

From my experience you'll go onto a list for bill collectors. You'll probably get sent mail monthly and get phone calls every couple of weeks. They can't pull money straight your or your dads bank. If that as the case ebay would have no sellers because they wouldn't be able to fight disputes, the money would just be refunded without confirmation.

I'd strongly advise calling Ebay directly and trying to sort it from there.

I called ebay 3 times by now. None of the representatives seem to want to help me, and they ignore some of my questions by changing the topic and telling not to worry. How can I not worry if I'm gonna be forced to pay back 1000eu? I keep teling them the description was accurate and that there shouldn't be a refund. And they reply with, "don't worry mr ........, just check the condition of the saxophone and everything will be fine". What in the world does it mean everything will be fine?!

You can keep calling until you get a nice and fair rep.

Because the money went to your dads real bank account now they have your info , if it was stealth account you could simply say "i dont care i wont pay and they cant get the money from me".Now probably they will send bill collectors from some agency as when an account goes negative they sell that debt so the debt agency will try to get it from you.I think your only hope is to win the case , once the product arrives to you take pictures and a video and send them to paypal to prove that it is as described.Best of luck to you , from Greece (i like your username btw , its a tasty desert)

Did you specify how long your willing to take a return for refund? Also theres no saying if he damaged your item and because of this sent it back, since these kinds of items are sensitive and quality matters, so i'd express these concerns with ebay. In the mean time make sure they bank and or credit cards are removed from the paypal account. When you Un link them, paypal cannot dip there hands into them. And if there are no funds in the account, paypal in all my experience, cannot take the money out of the checking account. Like said above, they most likely will send this to collections.

This sucks because what if the buyer used the item then just got bored and scratched it up and said it came that way?

They aren't going to do anything for you - your going to be out the 1000eu

the Buyer sends you back the item - you really should have left the money until after whatever refund period has passed
to be safe.

You better figure out a way to square up with Ebay or your going to collections.

Just ignore them, there is nothing they can do. Tell buyer if they want to resolve the issue to bring the sax back to you and tell ebay this is the only way you are willing to solve the issue as you are not prepared to be scammed out of your sax and money.

They get a bazillion such calls a day about chargebacks and returns. Ebay is not bad, I've done tons of business on it without issues, but I've always made sure my descriptions were absolutely precise to the point of being pedantic....so if there were issues, everything would be in writing.

Ebay is a great marketplace, but you gotta realize you're dealing with real people that are spread across the world. It's hard selling something in person, it's much more difficult selling virtually.

Yes do this, then if the buyer doesn't use tracking/proof of delivery just say you never received it back.

Sorry I don't have any more advice for you, but a lesson to all, NEVER put perfect or like brand new when it isn't brand new, whenever I buy something off ebay and the seller does that I know I have them by the balls if I don't like the item.

to be fair.. if you get your sax back then the guy/ebay should have thier money back also.

Yeah this is off the chain, I mean I feel for you man.Dude may have planed the whole dimenstration and once he had no more use for it figure to return the sax and plus get his loot back.The nerve of some people.Well its most likely going to collections but they cant just go into youre account any kind of way. Thats illegal.Keep trying to get a rep to help.Its got to be at least one good rep. Good luck man.Peace. PS. In my region this is a crime unless it was really stolen...not a lawyer though

Did you say the sax was scratched in your description, or did you just say used?

For eBay, you need to be VERY decriptive, used is one thing. Used and scratched all to hell are two diffrent things for a shiny metal instrument.

Thanks for your feedback everyone. I now learned the hard way how descriptive I have to be. I listed the saxophone as used, and when I did so the used part said that the item can have scratches and dings etc etc. So I thought I was covered concerning the scratches. When I wrote like brand new, I meant the condition of the saxophone is brand new (which it is!).

So I'm gonna call ebay when I get it and fight for this because just the idea of getting scammed annoys me so much. And if they don't agree and I have to pay, I will let them take it to debt collectors. What can they do? Harass me all day? Let them harass me. If they want this money they should sue me, and at court I will show them I did nothing wrong. And if I get jail time, then so be it. I prefer doing jail then letting some guy scam my money.

The only reason I'm worried is cause my dad's account is on paypal and I don't want him to be in trouble, he already has so much sh*t on his head.
Btw, I also can't remove cards, or change adresses/names on paypal cause of the negative balance. So all the info is there.

I am done with ebay and paypal after this. I have 100% feedback rating, and they're treating me like I'm trying to scam someone.
