How to fight Paypal Chargebacks ?

    I run a web development company.
    I got a order from a USA client for developing 3 sites at 900 USD and got 300 USD as upfront payment.It is paid under service from the client

    We started working on the requirements one by one.
    We delivered designs for three and development too.
    Designs were changed many times and we completely worked with them for reasonably long period.
    There were no clear cut instructions from them,but we keep on doing our work to please them.
    All of the sudden they posted "Paypal Dispute"
    I submitted the evidence for the service and i won the dispute.
    But now i got a Paypal Charge back outside Paypal.
    How can i fight it ?
    How can i win this case ?

    Additional details:
    Chargeback is a process initiated outside of PayPal by the credit card
    holder, and the outcome of the chargeback is decided by the credit card
    company, not by PayPal.

    The buyer claims that the item was damaged on receipt or is significantly
    not as described.

    You can't won it if it is charged by your client's credit card company or bank. It really sucks and I lost some funds due to this problem but we have no control over it.

    Yup, call Paypal. I believe if they do a chargeback after losing a dispute their account will get suspended. At least something happens to them.

    You won't win. A CC company or a bank will ALWAYS be behind their customers.
    I had the case with guests renting my vacation rental property. They enjoyed and after leaving they charged back. While Paypal was with me, American Express got the money back to the guests even with signed agreement and paper works faxed to them.
    So I think you're screwed...

    Did you give the customer the source files etc already? Did they pay the whole amount? And do call PayPal! Do not give up without a fight!

    I guess for the future it would be good to document your customer's acceptance for different stages of work as completed and satisfactory. This could be best done via companies like elance, scriptlance (which may give you undesired competition of course) or an escrow system.

    If you get any chance of direct contact with the CC company, then underline the fact that the card was used for a PPal transaction and settled in a dispute case. And do mention you would like to charge the client extra for the time wasted on this dispute. Sometimes attack may prove as the best defense.

    Yup some bastard did a chargeback on my one of my programs and took 4 months back which is bs since he used my program all that time.

    Everyday I hear more and more about PayPal disputes, (I currently have one going on) but their system has all kinds of cache 22's that need legal clarification. They empower the buyers with all kind of tools to defraud a seller.

    Do not be afraid. That customer is US citizen, isn't it? And he/she is using your copyright material -- so change your angle and look for how to get him nailed through the US copyright act (or whatever). Alslo give Paypal details and ask it to fight this injustice. You won't succeed if you don't take actions, isn't it? :) So if there is even a 1% chance of success, go for it.

    This is the cost of online business. Every now and then you stuck with a dick who gets the product/service and then claims he didn't. You would better do background check on customers before approving orders by checking their feedback on the marketplace where you and the client got connected together.

    Did you have a contract or email exchanges? I know that with a credit card company you can send that information to fight it... but I'm not sure if that works with Pay Pal?

    Do you have access to the site at all? If it is Wordpress you could disable it somehow...if they didn't change everything. I did a site for someone on wordpress and I have access to it... if needed.

    Email him and tell them that if they do not give your money back that you will write up a rip off report on them and their company. You will also optimize a bunch of blogs with their company name and actual name, so anytime someone searches for their company or their name it will show up that they are a scammer.

    I have used this tactic many times in the past and it almost works everytime. No body wants their business being known as a scam or bad stuff written on the Internet about them.

    If you don't get your money back at least you warn others that they are douchebags.


    You should post their websites here just so we all know what assholes they are.

    hehehe and on the sidelines, register on a few p*rn sites, and sometimes offer your "services" to the men on those forums especially (if that person is a "man")... with his email address! If it's his company email address or a real telephone number, the effect will be much better :D

    Don't use your home PC to connect to those sites, btw!

    Sadly, this is not a legal advice though! :(
