How this site is still not penalized

hey, this is my one of the competitor website and he spammed his domain to death but still getting lots of organic traffic...

what's your opinion on this? can I easily outrank this site?

this site is using country-specific domain extension ( .in ) and I am also using .in domain

and his maximum do-follow DR rating is 27 only

Why do you think its going to get penalized?

There is no evidence for that at all.

If every spammed website got penalized google wouldnt return any results lmao.

He might get good rankings initially but they will not last.
 
This can be temporary, if it's spammed, it can be taken down anytime, Yes, it's possible to outrank if your content is better and focus on quality backlinks.
 
one possibility, it TOS is higher than yours. But if he was doing spammy activity, then it will not last for longer.
