How do these videos get by with copyright issues?

Videos like https://www.youtube.com/watch?v=mgmVOuLgFB0 and https://www.youtube.com/watch?v=mgmVOuLgFB0 are able to get by without copyright issues and monetization. Is it because of fair use? (seconds of each clip)

What program are these videos being made in to bypass the YT ID system? I know there was a thread about this somewhere in BHW a few weeks ago, but I can't find it anymore :(

Also any tips to avoid getting caught would be great. I know things like altering brightness, zooming out, and cropping will help.

It's because its fair use.

They are using clips and footage that does not belong to them, but they are editing it together and adding value. Not just ripping it and uploading it.

They could well get taken down if an owner of the clips puts a complaint in, but until this happens they will not have a real problem.
