Help me! Copyright infringement

We took some articles from a big company and rewrite it and sell. Now we are receiving their copyright infringement cease and desist letter. What can we do? Help me please.
1, we have totally rewrite the article. But they still claim they can sue us. Because the core is the same. And the title is the same.
2, we have no experience on offshore hosting should we go that route? We don’t want to give up without fighting back. But they are big companies and hired lawyers and we are scared.

"Good afternoon,

i have read your claim and i apologise for any confusion but we do handwrite all of our articles.
our writers assure us that said articles are created with no copyright and or infringments.
I have not read your article before but i have since receieving your complaint.
i have checked copyscape and found PERCENTAGE amount.
in saying that, yes, copyscape is not 100% foolproof and nearly all articles across the internet will show a percentage from another article somewhere on the internet.
i have asked my writer where they obtained their source from and your article/website was not mentioned or provided as a source of information.
Again, sorry for the confusion and the appearance that it may be part of your article, but rest assured, we will make some alterations to what is seemingly copied from your article.

If you have any followup questions or would like to obtained a final copy when it is ready to be re-released, feel free to respond. i will gladly send through a copy.
Please note though, as i have previously mentioned, we did not copy anything from your article so unfortunately we will currently be not be taking down our article, but providing an updated version to stop any conflictions out of the goodness of our heart and respect as one business to another.

1, What do you mean "too late"? They already got my name and they can sue me?
2, They are a big company. Do they really going to sue us such a small company? Maybe bad for their reputation I guess?

International suing is hard, and does not work like local court.
Do a thing, take a backup of your site right so u can be safe from hosting ban

Just dont reply to them. If they are very big they will not invest much time if you dont reply. But first move immideatly offshore.

What makes you think they won't invest time if you don't reply? I think it's the worst thing you can do by not replying.

I think you may be missing the point, rewriting doesn't necessarily protect you.

Imagine if you rewrote Harry Potter series. Maybe you changed all the names and none of the sentences were the same. But it still told the same store. That's still copyright infringement.

copy 1 to 1 what they sent you and sent it back to them it's not helpful at all but it is funny

ps. you're too late for off shore. if they sent you a letter dont worry they have already saved all the proofs what is the best thing you do is, accepting your mistake and apologize even if that might cause you to lose all contents... I dont know anything else

IMO just do a quick site backup first then send them an apology accepting any wrongdoing. Tell them its an avoidable mistake caused by your team of writers and that you have penalized them.

If you have DMCA or copyright protection, you can submit your website, evidence, or claims to the domain provider and/or hosting services to get them taken down. Depending on the local law, you may be even entitled to revenue earned from their content, and you could threaten them with that.

Change the damn title is the first step. I am sure that is how you were sniffed out in the first place.
Also get a better article spinner that will make the content more unique.

All of the 'move offshore' stuff sounds sexy, but they already have you in their clutches so unless you plan on physically moving offshore, moving the site at this point will not help you with the entity currently after you. It will assist in future attempts at litigation but even that is not bulletproof.

But changing the title if you haven't already is the main thing.

When you re-write an article, you accept risks of copyright infringements! It does not mean you actually have the right for the “said” articles, in other words: you are using someone else work, and thought re-writing and passing copyscape will protect you and you now the owner of the new articles. You are not, specifically when the original articles were written after tons of research, and cost a lot of money for the original owners, for example: let’s say they write about certain disease and the success of a certain treatment, they may have done research to support these claims, so you come along and re-write the thing and think it’s ok? You should accept this fact, accept their DCMA, stop doing what you are doing because it’s not a good long term business plan. Instead: try to change your business model and hire new writers to write great articles that you own the right for.
This big company already got you, you will NOT be able to run away from them with your current domain, your name, your site is gone bye bye. Unless you start cleaning up the mess.

You know what’s next right? Your website may get penalized by google and the rest.

While articles re-writing & spun articles and the like may sound as good way to make money, it is not a good business model. There are always risks of the original owners finding you.

1, we have their company name and the original article title in our url. Does that mean we have to take down the url? We keep doing seo years to get this google rank.

2, how about we stop the monetization on these articles and make it free. All we want now is the google rank.

3, is there anything holding them back? They seem reluctant. Maybe they are a public big company and they don’t want news?

4, what’s the worst case?
