The fact is the guy made a lot of really good money, and if he had played the game a little more intelligently he might still be making money from it.
For example, he could have incentivized the entire process by "actresses" to play the role of potential swinging couples, and buried the existence of the definition of their role(s) in the fine-print of the ToS that no one ever reads. Any overt complaints and a link to the ToS is given, and a refund is immediately and quietly issued, and business continues as usual. These actors/actresses make $5.00 of every $40.00 that converts, and are required to string them along until some pretext for severing communications comes up; a family emergency, a job change, etc...
All these supposed black hat marketers with their underwear all wadded up, carping in self-righteous indignation about WHAT someone else did, when instead the could be focusing on the HOW, and looking for ways to duplicate, improve and scale-up someone else's business model in order to realize even greater profits than he did, with a higher degree of safety. It's these Pollyannas carping about how someone else isn't black hat that are the ones that really AREN'T black hat. Isn't there a Church Lady forum somewhere, for self-righteous moralists that can't see an economic opportunity when it is kicking them in the shins and calling them names?
