one of my sites has had a penalty. was no2 now steady on 12 and has been for just over two weeks so defo not a bounce. do any other users have experience of penalties? does it take a manual review to recover? do you have to clean and tidy up it paid links/networks etc.. or like a sandbox will it come back given time.. any help advice will be most appreciated. thanks

If you only dropped to 12 there is no penalty involved. When Google slaps your site you are not going to still be on the second page.
Google has just decided that #12 is where they think your site belongs, no slap just a revaluation. Either something in an algorithm change caused your site to drop or the sites that were below you started doing a better job. Probably the former as they have been tweaking a lot lately.
Your job is to try and figure out why and go a better job. I would first look at all your on page factors as Google does seem to be placing more emphasis on content than they were a few months ago. Clean up your site if needed and improve or add more content and go from there.
thanks Volund for your time and advice. many people talk about the 5 10 and 50 rule so i was bending towards a penalty. wierdest things though is that if it was a penalty the penalty has not spread accross my other money sites as the same type of links are on them too. but no effect or drop there. but thanks again for your advice. 
it was recommended to clean and tidy the baclink profile.. ie get rid of the private networks and high pr paid links etc.. but then would this not have a negative effect and take me down further? or could it help go back up.. has anyone ever removed high pr paid links and what was the effect?

It might be a change in the algorithm or something else. The best thing to do is act like nothing happened and just get back to work. Just keep working on your site and building more. Honestly, the more sites you build the less you will care about one site dropping.

Read somewhere that these minus X penalties are results of bad link profile, especially no varying anchor text coupled with sudden blasts. The author suggested to add links from different sources than what you have now with varying anchor. So if you have SB and Xrumer links add web2 and articles, etc..
I decided to give it a try for a couple pages that has been hit by an AMR blast and went from first page to 10th page for 2 months. Done a 10k direct xrumer blast and surprise, 3 days later both pages are on page 5. I bet they will be on first page in a week.

Sites always bounce initially after a build. The size of the pre-existing backlink profile typically controls how much (new sites bounce like a mother).
Like everyone has said, though, you did not get a penalty. I have A LOT of experience with penalties, both being penalized myself and getting clients who need to figure out a way to recover. The issue is Google's data layering. When you get penalized you get pulled from the index so you cannot be show in the results, your site and information, however, are kept in the data layer so any changes or attempts to subvert the penalty can be tracked. Additionally, penalties are typically laid down for 3-6 months (normally 6 months) so the only option is to typically scorch the earth, work other angles until the penalty is lifted.

You did 10K xumer blast with a lot of diferent anchor texts ?

This is really about the best advice there is. This reacting to every move you make in your rankings will only lead you astray. Just keep building links, improving your site, and building more sites. If you do that you will find the money will take care of itself.
Really I plan out all my linkbuilding long term. With a brand new site I plan out the first three months before I build link one and do not even look at the rankings until a couple of weeks before the three months is up and I have to make another plan.
