Getting sued, want to share my thoughts!

Don't worry. Just remove all of their images and other copyrighted material.

I have been threatened to be sued many times. Even if they do sue you they can only

recover the damages. Which is only $1.00 per day. Just ignore them after you remove

their stuff they will go away.

If both of you live in different country, just ignore that.

Don't they have to tell you to take them down first?

Don't waste your time with it...Just REMOVE what they are complaining about and you should be fine..You're being threatened because they want you to take their images off of your site. If they say hey wonderful person, could you please take this stuff off of your site they might not get the results they seek.. You're fine man this is the internet...No laywer needed just common sense.. I was in worse than that and I didn't even bother to comply

Just scrape the whole website, edit the payments to suit your requirements, and make bank my friend.

You will surely have enough dough to keep big bubba from raping you when you get sent down, and some spare cash when you get out.

I JUST started autoblogging and now this gives me 2nd thoughts. My real info is hidden behind the provider but with a proper supoena, I suppose they can forward the legal notice to me. But I would think my provider would send me a warning first. I also think it is against privacy laws for the provider to simply give out your real name / address. Even when music companies sued against torrent users, all they had was a list of IP addresses and not actual names.

This is the reason why I no longer make autoblogs. Too many complains.

If the site or sites the content comes from has an RSS feed, and you are pulling content via these feeds, there's not much they can do. Having an RSS feed signifies that the original creator/author of the site wants to have their content syndicated.

I don't believe images are covered under this rule, but I know that anything fed through the RSS feed is.

Well i haven't read a lot of the other replies but figured I would just share my experiences with you.

been doing seo for about 3 years now. My 1st two years of this I received 0 C/D's over the course of just this year alone i've received over 40-50 C&D's

Who knows why so many this year or whatever but it was literally a pain in the ass the first 5 I received I freaked out totally. I had quite a few websites that were doing 700-800$ a day that I gave up. (yes I know Dumb move) So after that I've talked to 2 separate lawyers.

They both said that they 1st have to send you a C&D through regular mail if you get one through Email it doesn't really count. Or shouldn't take it to serious.

2. After the C&D they have to send you a DCMA compliant which costs them around 1k to 2k just to file. So you know if they file that they are pretty serious about sueing you.

3. For all the laywer fee's etc. etc. etc and they I guess have to go to where you live and sue you. So the cost for them alone to sue you would seriously let you know how serious you are.

Since than I don't really pay attention to the C&D's unless a DMCA compliant is filed.

But let me just add my little disclaimer here. take what I say or whatever anyone says on here with a grain of salt.

i'm not a lawyer so I don't know exactly if this true for where you live etc but just sharing my experience of what I have gone through.

I don't know who is trying to sue you, though I will say this.... If it is Getty Images, then be prepared for a rough ride, as this company goes to town on just about anyone... I have witnessed first hand what they have done when they found an image of theirs on a friends website... There is no apeasing with them and you will need to seek legal advice.

If it isn't, then email the people and see what you can do to apease the situation.

that why it always best to create your own stuff and hope nobody steals your hardwork that you created on your blog


autoblogs have pros and cons. i think mosly cons

I know of somebody the same thing happened. Just remove the images imediatly. It should be fine. Thats what my friend did. Nothing else became of it.

Most of the advices in this thread fits to u.s. - Not Germany. Here you are fucked up. I've been in three lawsuits of this kind and had to pay two times - Even with a good lawyer. Ignore the advices here, will Be the Best advice i can give you. Sorry, man.

Never knew Germany's internet/web laws are that strict and the OP will come to this extent of the Law. Don't know who's sueing OP for what but I just hope he'll get out of this in no time.

...yeah most here dont know how screwed up German internet law is, so this time try to settle somehow this issue, next time start a UK limited. host outside Germany, disable google cache (in case you have to put down images/files there is nothing than on google cache and scraper copies wont float around).

Just remove the images and copied stuff - let the dust settle and see what happens
