Getting sued, want to share my thoughts!

send fake letter threatening to sue, ask for settlement offer, take down your competitor, ha!
 
Does anyone here besides me get pictures from public domain like wikimedia and picdrome?
 
I agree, remove the content, send them a simple letter saying that the content has been removed, you apologize for the mix up, it was an addon to your site that happened to grab the info and post it up there.

If they pursue, ignore them. They have nothing to get, in court if there is no proof that their "copyrighted" content was used or was on your website, they have no case. If they have "proof" you show proof that it was removed the day you received the letter, and that you informed them of such immediately.

Really, they have nothing to get you with, and no self-respecting judge would uphold them in court if you got rid of the content once it was brought to your attention that it had been grabbed automatically from their site.
 
dont pay until a court orders you to ....

send a letter saying a dumb temp did it and you fired him with etreme prejudice...

get a offshore host and private reg ...

Write a letter back in Arabic (or Japanese) font with a question mark at the end.

You do never ever reply, ever.
You can effectively avoid cease and desists this way also, as email is not sufficient evidence of receipt.

Start LLC for your company
Process with said LLC...
Transfer all hard assets (homes/cars/property that you buy to avoid paying taxes on profits, etc) to another LLC, in that LLC place the assets into a small interest bearing trust.
if you get eventual trademark claims (trust me even with huge companies, and 100ks coming into your company, this can take months to raise red flags)... you simply file for bankruptcy on LLC #1

The investments in the trust can be charitable and ergo, impossible to touch.

You seem to have a good setup plan. Do you have any recommending readings/sites/books to help someone that is just starting off and needs as much info as possible?
 
God, that sucks ass!! Some people really don't have anything better to do!! I'm sure it'll be alright, just plead ignorance and put you 'puppy eyes' on!!
 
Had similar situation one some company wanted to sue me because my url shortener I was running back then with one guy was linking to a pirated website of their software... Actually it was not linking, the url of that pirate website was shortened.

I recall they tried to get the money and they did'nt care that we deleted that shortened URL.

So my advice is, remove the content and dont bother with them anymore, because they cant do a shit they are only trying to get the $ out of you and scare you :), they are not rly planning to sue you ;)
 
Typically a cease and desist is issued before they can actually sue you for capital gain...at least this is my understanding.
 
Fishing expedition by sleazy attorneys. Just ignore, its far too costly for them to pursue you.
 
If it was an email, disregard it. If it was a letter, send an apology letter back and take down the images.
 
I also got message from a company whose contents i was using to my autoblog they said to remove all posts Instantly. So I do and now i am safe i donot know why they are trying to sue you and sending letter to your physical adress. They have to inform your hosting or Domain registrar firstly.

Just take the pictures down and ignore the pricks who sent the letter, they are just trying to find people who get scared easily to try and get money off them. If they just keep sending these letters to more and more people they'll end up getting paid from some % of the people. That's the business model they use.


yup this is very true, its a scam done in many similar forms, lately there have been people sending fines for downlaod illegal music, and foolish people babbing their pants and paying!
 
its funny im reading this b/c I was just trying to do some research on this topic a few days ago. I know autoblogs get their content from other sites of course I just didnt know they get them from sites that copyright their content.
 
Dude, don't panic! I received 2 letters when autoblogging! I swear to you nothing happened.... I started buying WhoIs privacy service with my domains and they never knew me since then!
 
Anyone can sue anyone over anything that they want. Is all about if they have the money to do so. Just take it down and send a letter saying you removed it.
 
someone will serve you in person if you need to goto court

so if its just an email

remove the offending material and move on.

as far as if you were used then yeah - doing everything in a company makes sense - cause if the company had no assets - then they can spend all the money they want - they can't collect.

just close the company.
 
if you going to do those type of blogs create fake registers ... I got emails before I just quickly removed them .But I am running a vonage domain name .They said they would sue me copyright on any uses of vonage domain name . I change dns to no where for a while then faked the register and restored the dns .
