Getting sued on redbubble in America

So I'm in Australia selling designs for a popular fashion brand through redbubble. I made about $1000-1500 AUD in sales over a few months after redbubble took their initial 70%. Not to mention I was not on the front page and there were hundreds if not thousands of other artwork the exact same. Redbubble are quite notorious for having constant copyright stuff up.

Anyway, without any cease and desist or warning I was issued a copyright infringement lawsuit and was told to appear in court earlier this year. I only got a registered email, no mail/serving or phone call even. However they also took down my paypal and limited it.

The other day they sent me another email saying if I don't settle for $25k in the next fortnight or so, I will be default judged for 300k.

I then get a FedEx Courier Mail today with mail that just repeats the above email.

I'm just wondering if this is even legit at all? I really can't tell if I should bother negotiating for settlement or just ignore the whole thing as I don't care about my Paypal account whatsoever.

I have seeked legal advice but not a single lawyer i've asked has any solid idea or plan if this is even legit or what to even do.

They are pulling intimidation strategies on you. This is extremely common. Stand your ground , chances are you’ll be asked to stop selling and the prosecutor will be left with huge legal fees so normally they’d bail last minute anyway because of this.

Where are they trying to get you to appear in court? Aus or US?

Regardless, don't take advice here you NEED to find a lawyer who has an answer for you.

The OP posted the thread because he was in a bit of panic and then dissapeared. Chances are he stopped with selling the affected designs and everything came to an amicable end.
 
I would love to know how OP is doing, as I've also just been served via e-mail. I'm in Canada, I'm going to reach out to an intellectual property lawyer and see what my options are.

Me too I just got served today through email. I literally made no money on Redbubble so I deleted it. Im not sure what to do, thoughts?

I'm fairly sure that being sued requires you to be served in person or by mail. If I understand it correctly, the courts require serving to be done in person to verify the party has seen the papers. I believe it can be done via regular mail & certified for record keeping, but don't quote on me that one.

IF you have consented to being served/sent official court documents via email, then you can be served via email, I believe.

I am in Canada as well first I got a notice from Paypal that my account is limited then in order to clear the matter up I had to respond to an email responding to Copyright infringement. This is just sad because it was a stupid hobby I picked up due to the pandemic. I literally made next to nothing on Red Bubble, now the bastards are trying to extort 5000 US out of me. Anyways I'll attach the evidence they sent me. They served me as well. Don't know what to do. I told them they should sue Redbubble and if they think they can threaten me they are pissing in the wind. (I literally made nothing) Its almost humorous how bad my luck is. Lol..
