Getting a domain back

One of my client web sites was developed by a developer, and he is not giving his domain name back to my client account. The developer took the domain from register.com. The domain shares the same name as my official business name. How can I reclaim the domain from the previous developer?

Like said - contact a local lawyer who is familiar with this niche.

Just curious, is your business name a trademark?

ICANN oversees Generic top-level domains (gTLDs).

Going the lawyer route is going to be expensive so make sure the domain name is REALLY worth it.

ICANN = Free (Just see what they have to say, make sure you write a formal email, not just what you posted here as it will most likely be ignored)

I will refrain from asking how on earth you let a Dev have control over a clients domain name but this could turn into a hard lesson.

A local lawyer? This is ONLINE. (Really wish there was a downvote option)

You need an IP Lawyer with experience in the domain industry.

Please ignore the comments made on this topic thus far as they are absolute useless.

Get in touch with ICANN first and the Register the domain is with.

Do you think they will take action or choose a side if it's not a trademark? I'm not sure about that.

Imo, ICANN often comes after the register if they refuse to help.

There aren't many other options, a lawyer will also need to get in touch with both.

Any email proof, any proof that the domain indeed belongs to said company etc will help.
 
Is the case where the client being lazy asked the dev to register the domain under their account and paid the dev the domain registration fee?
Just asking because it's very common especially with local businesses.

So yeah, I agree. Better to start with the easy and no-cost option in this case.
