Generic TOS and Privacy bad for SEO?

I know many people are in rush and most of them are using generated privacy and TOS.
Well when so many people are using that exact same text ins't google gonna recognize that as duplicate content to new sites and banhammer them?
Any thoughts on this? And if im safe can you please explain why. Thanks a lot guys.
