FTC is cracking down

    woke up to this in my inbox from bluehost. I know the FTC was trying to pass new laws a few months ago, but I have not heard anyting else about it. Looks like they are getting their way.

    The part that bothers me the most. Seems like they want a disclaimer next to each ad, affiliate link, or even a review and not just in the main TOS.

    Today a letter from Bluehost, tommorow a letter from adsense, the next day a letter from the FTC shutting us down. Better start investing in private DNS info even for the white hat sites I suppose......

    One of my hosting affiliates sent me the same notice yesterday...

    It sucks and is going to hurt ecommerce / affiliate earnings big time.

    Turn that around!

    Say something to the effect of "Sure, I get paid from XYZhost when you sign up from my site but so what? You want the best hosting at the best prices with great customer support?
    Buy your hosting from XYZhost!

    I received that kind of letter too from hostmonster.

    cracking down in the EDU sector as well, they are getting tight with us

    I read that as; if you say it's a great product then try and sell it to them without informing them of your commission your breaking the law. But displaying an advert for flights to Peru on a blog about travelling Peru is fine, as long as you don't claim the airline for said flights is the best.

    So review sites are out by the sounds of it. But merely serving an advert without expressing any form of opinion on the product isn't? (I'm saying it isn't but I don't know, not a lawyer)

    The real question here I think is what is considered as an endorsement?

    But also what about the average ads3nse webmaster? If they have a review site and G is serving ads that advertise the reviewed product, where do they stand legally? They didn't choose that advert, G (More importantly a computer) deemed it the most relevant and chose to display it.

    Another day another regulatory mess. If I compare e.g. GD with HG, list PROs & CONs but finish with "There you have it, now you can decide for yourself"... is this an endorsement? Or a double exclusionary endorsement maybe?

    If nothing else, the new rules will make it very easy to harm random affiliates by using their links in a bad way and will also add another branch to the cloaking art.
