Most of the PBN services offer you footer link in BHW. But i recommend you to don't go with Footer links. Because it's not working now and also it turned into spam...

Any proof that these links are not working ? For me its still working fine and ranking is also good.

The footer links can be good if used correctly. You can buy few relevant footer links and it can help rankings. There are other ways of using footer links like SAPE that can skyrocket your rankings.
Many wordpress theme developers leave link in footer to their website and popular ones probably get 1k footer links i don't think that will penalize them if they use site url as anchor.

Yes, usually those theme creator sites have crazy high PR aso. I have seen PR7 theme design sites and I am pretty sure all their link juice came from the footer links they left when selling/offering the themes.
