If it's transformative, then you can use movie clips etc under the fail use policy. So for example if you're doing a history of a movie character, you can use different clips from that movie with a voiceover etc.

Just because there are adverts on the video, it doesn't necessarily mean that the uploader is monetizing that video. It has most likely been claimed by the company who owns the rights to that movie and all the revenue goes to them.
They may just be doing it for fun. Not everyone is a marketerI thought about that too, but on the other hand, some of these don't actually sell anything else, so if what you said would apply in every of them, wouldn't they just stopped growing the channel?
