I received a letter from the FDA I suppose and they are contacting me because a customer complained to them about my product burning them

They told me they want

“ “We request that you provide us with the following information:
• FDA clearance or approval number for the xxxx (product item)
• The basis for your determination of whether or not you are required to obtain FDA
clearance or approval for the (product item)
• The current version of the device labeling, including but not limited to your instructions
for use.”

The problem is i’ve been researching the approval my supplier sent me who is from china and this FDA seems fake but I do see the registration on the FDA website but the product name is mixed with a bunch of others

This is a beauty product and I’ve done millions in revenue on this store any advice on what I should do?

You sure it's real? They got the February date wrong, saying 2024?

that’s what i’m thinking too but the email address lines up with fda agents also never received prior emails before unless my va deleted them, hard to tell if it’s real or not been looking into a lawyer to check

If its legit, lol you would have to really confirm that, just tell them the truth, you got that stuff from china, you didn't enforce any product conditions regarding ingredients that could be harmful to skin and that you didn't ask your supplier to prove whether it was safe or not, and to be honest you had no clue that it could be dangerous, you just wanted the cash. Nobody complained till now so it must be ok right?

:)

Close the store. Repeat the process you learned with the legit supplier and do the same again. Otherwise, it was just luck and not skill with which you made millions the first time with.

If it is real then, do whatever you can to get "lucky" a second time with all the right conditions in place, and let the FDA go after everyone else, while you build a new and profitable business again. Doesn't have to be in the same niche, you could do whatever, as long as you start in a smarter place, and be aware just what kind of background checks you should do for products you sell. Robert kioyaski the famous author of rich dad poor dad started with surfer velcro wallets fad, and made and lost a small fortune for him at the time. But he never stopped developing and selling products and doing sales for the rest of his life.

Before you panic, first of all check carefully that this is not some phishing or scam attempt.

Keep in mind that the Trump administration will be trying to dismantle the FDA and it's ability to regulate the market, so even if you are in the wrong here, keeping quiet might just do the trick.

Ask the manufacturer in China to provide you with the their FDA manufacturer registration number.

Talk to a lawyer. A cosmetics device might not fall under the FDA regulations.

Don't respond to the FDA before you have talked to a lawyer.

If you are not in the USA, this might not be a real problem for you.
