I think that the point has been lost. The idea that Facebook can "charge" you $1 per email is based on the fact that in previous anti-spam lawsuits trialed, or settled out of court, the average amount sought in dameages has histroically at least on one occassion been on the average around $1 per documented emails sent.
It may be a sensationalized and much overstated statistic, but it is all a part of internet urban legend for a reason. Facebook can, might, and has in the past, sued, and even sought various criminal prosecution for e-gragariousspammers.

stay under the wire ...
segregate and concentrate ... reducing risk and increasing profit ...
go legit.
(and if all else fails, rinse and repeat)
