Facebook cease and desist. What to do?

    Hi Guys,

    I need your advice.. I receive a cease and desist letter from facebook lawyers.

    I am selling social exchange bots like like4like bot because the bot is using facebook and instagram to generate points and in exchange for likes,follow etc.

    They already deactivated my facebook account so i know this a legit letter.

    These are the things that they wanted me to do:

    - Shutdown the website that operating the bot selling
    - Dont ever register to facebook and instagram again
    - Send all my customers details
    - Send the source code of the software that i am selling

    My questions:
    - What if I just ignore this email? Is there a way for them to track if I really open their letter?
    - What if their email went to my spam folder? What will be the consequences?

    Im afraid to reply to them because that will just make me guilty.

    Please advice.. That website is my bread and butter right now so i dont know what to do.

    BTW I live in the Philippines.

    Shut down all of the accounts, websites ect and just make this disappear all together with no trace. Reopen as new service new site etc. Be smart though and put layers between you and anything new you set up.

    By all means, do NOT send your source code and the customer details.
    Relocate your server to somewhere not within US laws. If you are already outside US laws, just laugh at these cease & desists.

    Make up some random names for your "customer details".
    Make up some not working code for your "source code".
    Then just create a similar business, OUTSIDE United Big Brother States of Murica.

    Send them an email telling them to go suck a dick (don't actually do this)

    You live in the Philippines, they pretty much can't do anything.

    Twitter tried sending the feds on some guys in the Philippines and they ended up just calling it off. Take some proper precautions, move your site to a more lenient hosting location and keep on doing what your doing.

    Whatever you do don't play ball with them, because you'll just incriminate yourself.


    By the way, i like your name. That show is awesome can't wait for the next session.

    The only thing they can actually insist that you do is;
    - Dont ever register to facebook and instagram again

    Other than that, they can go whistle for it!

    PS - and as the others said, DO NOT under any circumstances give them anything! It would be totally foolish of you.

    I got the similar letter, have close all my sites.

    But, is it better to reply them, or just shutdown everything and keep quite?

    How to reply them for salles details, customeers and source code?

    Can they use my reply to suee me, i don't live in US?

    Impossible to sue you at all.

    1st: You're not residing in U.S region nor anywhere near.
    Solution: Continue your bread & butter income

    2nd: C&D Lawyers only can send warning letters, they cannot press charges but only recommend.
    Solution: Mock at them happily.

    3rd: Forced you to review information.
    Solution: Laugh even louder as they will utilize these information to their advantage instead of yours.

    My recommendations is to stay low for few months, blast off once again by fool-proofing your strategy.
    Decision is yours to command.

    Move your site to a offshore hosting that don't give a crap about US and their retarded laws.
    You also got to make the payment you get for the bots to something not traceable (bitcoins,perfect money)

    I would just ignore all messages from facebook they can not do anything to you as long as you are in the Philippines.

    Sorry 'commoner', nothing personal against you in any way, but your advice is really bad, and fundamentally wrong.

    1) Lawsuits can (and do) get brought across borders, all day, every day. And judgments are easily enforced across borders, too.
    2) 'C&D lawyers' don't exist, but I suspect you were referring to the fact that a cease and desist letter is just written by a law firm, rather than a law enforcement agency. However - anyone can bring a civil suit, and criminal charges in most jurisdictions can be prosecuted privately, too. Yes, that means you can go to jail, without any police involvement at all, ever.

    That's the whole point of C&D letters. It's an attempt to settle the issue without having to go to court. It also means if it's ignored and the case goes to court, they can say they gave the opportunity to settle but you refused.

    "A cease and desist is an order or request to halt an activity (cease) and not to take it up again later (desist) or else face legal action."

    Besides taking down all the sites, is it necessary to reply the letter or ignore it?How should be the reply, details or just few words that sites are down and no longer available?

    This is just my opinion, so don't use it as advice:

    - To me, it seems like Facebook thinks that they own the world. *Facebook power-trip alert* I remember MySpace being in their position... look at them now.
    - Just because Facebook's lawyers tell you to do something, doesn't mean it equals the law. Or any lawyer for that matter.
    - I wouldn't hand over the source code without a judge's order.
    - I would definitely not hand over the customers details without a judge's order.

    I had facebook years ago... deleted it not that long after.. never regretted it..

    Here's the update of whats happening..

    I decided to shutdown my websites without responding to their first email and I got another email today.

    They are grateful that i did that but they still want me to shutdown another website which isnt mine to fix this cease and desist issue. They didnt ask for any other thing like the customers details etc.
    They thought that website is mine but im just an affiliate of that site.

    Should i respond to them or just ignore their next emails?
    Im sure the next emails will be threats why i ignore the last request.

    Since you've taken the steps to shut down your site, you need to inform them you're just an affiliate otherwise what was the point in shutting down your own sites?

    They are still holding you accountable for the same offence.

    Just point out their mistake and hopefully they will leave you alone!
