I just purchased a domain at GoDaddy auction. It was ranking before and now was derank because the website was down and had GoDaddy message there. If I put content back and add on page SEO will it derank for the same keywords and same position?

As long as the domain is clean, Google will deindex it as soon as you get it back up.

The content of the website is still owned by the previous owner. What if he DCMA complained about that ? It is possible right ?

Re indexed.

But saying that can change a bit here and there i guess but like you say dmca might go mad

Generally when you give up your right to the domain you give up the right to the content as well.

the person i purchased the domain from couldent renew it and so he might get mad if the same design is stolen. so i wont do that

If i just recreate it and the article still targets the same keywords will it still rank near the same as before

I can't restore it. The owners of the site before couldn't renew it. It was a restaurant. The owner passed away and I ended up buying it at auction. Originally to make a new site and rent it out because it's ranking for local terms. So I can get quick easy cash. But then I saw the businesses got a review 2 days ago. I thought they closed down so that's why they didn't renew. I called them and spoke to the manager. He told me the previous owner passed away so the person taking over decided they would make a new site. He said I should call Monday to speak to him. But anyways they are creating a new site with probably the same content so I can't copy it. But I will be taking to the owner to explain to him why he should buy the domain (8 years getting about 500 visitors a month, could easily rank for 2 800ms with some web2.0s) so hopefully he will buy from me.
 
Ahh I see, fair enough. Potentially they aren't so fussed about Serps. Being a restaurant they'd probably get most of their online traffic from review sites and social media.

I don't think they know much about their ranking or how many visits they were getting
 
I read the only OP, you need to put content again and see the results if it get ranked again for the same keyword.

im trying to use this and its not letting me choose a date. It is saved in the wayback machine so i dont know why its not letting me
 
That should work. Unless the website is about copyrighted brand or something, you shouldn't normally face an issue with DMCA. I have restored a few. So far so good. Add some new content and change the design to keep it looking updated though.
 
Putting the content back again is a good idea but you can also re-purpose your domain for a money site if the domain name is brandable, 301 redirect to boost your site or use it as PBN to boost your money site rank.

I've had similar thing happen due to domains expiring, SSL certs expiring etc. After you fix everything Google will re-index you properly pending everything is clean.
