So I have found a great site thats in my niche has good/great back links 0 spam and is really relevant - but the company just took the " - " out of the domain name and shifted to that. I can buy it but would i run into some kind of company copy write bullkrapp ? Its not a money site btw it would be used for the PBN cluster

Not a copyright issue. But a trademark one.

Yes if it's trademarked you'll lose it.

It depends if that name is trademarked or not. There is always a risk but if you are not spending that much money to get it, go for it.

301 the domain to another and use that as the PBN site

301 may be an option or you can try to create your own content, but never mention the name of the site or competitors trademark. But second option is more risky. With the first option never had any troubles.
