EMD Domain and Community Trademark

Hi Guys,

Need your help in understanding this! I registered an EMD 1 year back. They exact match keyword gets 49,500 exact searches monthly in the UK! It's a very profitable keyword in the travel niche. I have a .org and .com and .net are owned by the company which has a community trademark for the first two words of the EMD. Now as far as I know and have read, community trademark is only valid in the European Union (EU) and I don't belong to or live in Europe. So if I build a website will I be penalised for trademark infringement?

First the company offered me to buy the domain and later they changed their mind saying that I am violating their community trademark!

Please advice guys ! Coz I can't let this domain go as I know the potential of this keyword

I'd worry if they were a big company but if they are just a small company I dont think they'll go through the hassles just to get back a domain.

They are surely a big company in travel and holidays niche in the UK hence searches are so high for exact match words! I can kill it in terms of making money with it. U have replied back saying that I am building a website and if they have any international copyright then send it to me! If not, I will build a website and profit!

Another thing is that they understand the importance of they exact match domain hence they registered the .com and .net and redirected that to a different company site! They just didn't register .org which I grabbed it

If you build this site out you will lose the domain. The problem you have is that the first two words are totally relevant to the last word and the only type of site you can build is in that niche. Do not waste your time building this out.

The process with which they will obtain the domain from you will be a UDRP. Based on previous cases I am 100% certain that -

1. Not only would they win this domain if you built it out, 100% dead on certainty.

2. They could win this domain now if they wanted to based purely on the fact your landing parked page has links, that when clicked, show their competitors websites.

I suggest you remove the page from parking and just let it drop. If they contact you again you can transfer it. This is not a fight you will win, spend your time building something of your own.
