Hi,

If I acquired a huge email list of let's say people who might be interested in the online money-making niche and I send them promotional emails without them opting-in, can there be any legal action taken against me?

If yes, what is the safest way to do email marketing with bought/scraped email lists?

Clean the email list.

Yes, there can be legal action taken.
No, most of them will simply unsubscribe and mark you as spam, because that's easy
Your email service provider will suspend your account for spam after it reaches a specific threshold bounce rate and spam rates.
 
There can be legal action takes since you didn't have their consent.

What will happens in reality though is that you will get no sales and your account will get banned.

When you sending cold (not opted in) emails, you got to write smart copy, so people would not be offended by your letter. It is better not to offer them anything at first, just to ask them if they might be interested in something (your products or services) in the future.

Give them a choice.

If they agree, they can click "Stay subscribed button" if not, "Unsubscribe". It will clean up your email list and you might get good response rate.

Emails have to look personal.

Don't send 10k emails at once, Your ESP WILL terminate you. Start with 10-50 a day, test the copy, see what is working, then scale step by step. In a couple of month you can have 1-5k hot and opted-in email list. Do not import big email lists to your ESP at once. Send 100, clean them up, then another 100, etc. Otherwise, if you imported let's say a 100k list and the opening rate of the first 500 very low was, your ESP will blacklist the entire list and you are done.

If you do it like that, you won’t have to worry about any prosecutions and legal actions against you…

1. If we are in another country what is the chance of them prosecuting the sender? Especially considering the crisis, is someone actually getting so pissed off over an e-mail they will pursue legal action?

2. Does anyone have cold e-mail models that WORK WELL and are well accepted?

according to usa spam law, it s perfectly LEGAL to send some one an email asking them something like the following: "Hello "XXXXXX" , my 17 year old sister makes $1000.00 per day.... every day ....on her laptop. Would you like to hear more about this online method? If so visit our site : xcash.com.... join us, read our awesome tutorials, and make new friends with people making great money online !

((that is not spam)) then you design the landing page encouraging them to JOIN and collect their consent.
Do that times thousands and your list grows and grows.

You don't need that consent all the time.

For example, if you get like 2000 emails from Instagram users that have made their emails public you can email those people anything you want. Because the Instagram terms and conditions state that if you make your email public that means you agree to get offers from different people around the world. So basically that means you already have the consent and do not need some extra acceptance from them.

This is for everything where people have made their email public.

You probably need to give them the opportunity to decide for themselves and re-optin. Using a quality free givaway as a magnet would be less offensive. It depends on how you do it...
