Duplicate Content Question

This is just a hypothetical situation but I've been wondering about it for a little while now...

Lets say you copy an article from a website immediately after it's published, word for word, pictures and everything; 100% copy of the page. If Google crawls your page before the original source of the article, does the original page get penalized for duplicate content, or do both pages get penalized?

In the Duplicate Content section of the Google Webmaster Tools guide, they make a reference to a similar scenario, except with syndicated content:

Syndicate carefully: If you syndicate your content on other sites, Google will always show the version we think is most appropriate for users in each given search, which may or may not be the version you'd prefer. However, it is helpful to ensure that each site on which your content is syndicated includes a link back to your original article. You can also ask those who use your syndicated material to use the noindex meta tag to prevent search engines from indexing their version of the content.

What this means is that while the pages will not necessarily be penalised, there's still a chance that the content on your website will not rank as well if Google determines that the content on the other website is more appropriate.

Noone will get penalized. But if you do it constantly to a large volume - they will finally get your ass.

And, more than that, the site owner who is the owner of the content can easily file a DMCA take down for that page with his content on it. There could be real legal ramifications for stealing someone else's content, not just issues of duplicate content.

Hey mate,

Its a simple logic and easily find the copy content from google.

Google always track the every sites and easily find which one is first published.

Not always, google define a more trust site, as a primary source

you can get lock under Digital Millennium Copyright Act. Who is having original content if he/she apply for sure you will be penalized. Does not matter it indexed or not.
