Domain Expired, but can't register.. Backordered..

Hello guys,

I want to register some domain what on position 3 on G (low competition). The owner of the domain not renewed it and probably not will be. It still on same position of G, probably will not last where with couple of days, because it's already without the original website but, with godaddy landing page to backorder this domain(dns's changed). I made my bid at goddady.
It expired at 01/01/13 but goddady updated it to 01/02/13 according whois info probably to make auction.

1. When I will know that i can register this this domain or not? Only at 01/02/13?

2. If this so, by this day, i think G will drop this domain from his index or wil send it to 2-3-5 pages. Can i return to the same position with new relevant website without any SEO efforts from 2-3-5 pages or i will need to do some SEO? I suppose G need to consider that owners can forget to renew wheir domains and if it will be register again one-two month after that it should be return to the same SERP position. Isn't so?

May be wrong, but i think the owner still has so long to get the domain back....like 30 days? then if it has more than one backorder it will go for auction..

Godaddy have a habbit of buying domains and then charging a 'premium' for them, keep us updated on how you get on..

Usually, a domain name is not available for re-registration as soon as it expires. Most registrars allow a grace period that can be as short as one or two weeks or as long as a year for registrants to renew expired domain names. The actual grace period can be different for each individual registrar and domain name extension. If the domain name is not renewed, redeemed, or purchased through an auction, it is returned to its registry. The registry determines when the domain name is released again for registration. Once it's released, you can register the domain name through us.
