Some themes H1 the logo too, you have to look at the source code and see where it is. To be valid HTML, your page must not have but one H1 tag. You can have as many of the rest as you need, but avoid using H tags for emphasis. The content of these tags is taken as a heading, and if you bold the words "They can kiss my ass" (or whatever) with a H tag, your seo just went out the window.
Also some themes use a H1 tag on the logo, even for a graphic.
