DMCA - Copyright Infringement Takedown

I'm not concerned about the cost it takes to keep my work protected.
If your script is rented, it's not your copyrighted work in the first place. And since your images are on Imgur, you've already granted everyone else a license to use them as they wish.

As I suggested in the previous threads, this needs to be discussed with a lawyer. The Imgur hosting alone is enough to put your claim in legal question, and filing 20 potentially fraudulent notices, all under penalty of perjury, is more than enough to lead to a criminal investigation.

Wrong. Please guys stop this sharing of plainly incorrect information. You should have read the very next paragraph on Imgur:

Read the following paragraph:
Because a DMCA takedown notice, to be valid, must be based on a work for which the copyright is registered with the Copyright Office

None of OP's images are filed with the Copyright Office (I checked), so any DMCA claim against Imgur-hosted content will fail.

There is no need to reply and continue to fight with you. Please know, you are wrong and the sites will be changed and taken down =) Thanks for your input though.

My god man. I already posted EXACTLY where you are WRONG about the information you are sharing. Posting an image to Imgur grants IMGUR a license to share the content, it DOES NOT grant anyone else any license beyond normal fair use, which has nothing to do with it being posted to Imgur, everyone already has that right. Why didn't you read what I wrote instead of just coming and lying again about granting "eveeryone else" a license to use images as they wish?

Again, to make it clear:

With regard to any file or content you upload to the public portions of our site, you grant Imgur a non-exclusive, royalty-free, perpetual, irrevocable worldwide license

By downloading an image or copying other user-generated content (UGC) from Imgur, you agree that you do not claim any rights to it. The following conditions apply:

  • You may use UGC for personal, non-commercial purposes.
  • You may use UGC for anything that qualifies as fair use under copyright law
So please, I beg you, stop spreading false information to users on this forum. You are clearly wrong here.

The DMCA notice you posted is about filing a DMCA takedown with IMGUR when someone ELSE uploads YOUR content to IMGUR. It's not about people posting your content on their website or anything related to this thread. OP is not filing a DMCA complain with IMGUR. You just don't know what you are reading or what you are saying.

I'm not fighting, I'm sharing my professional opinion based on multiple DMCA cases.

The fact that you used the word 'fight' at all is deeply disturbing. Sharing a different opinion does not make me your enemy, so why do you constantly treat me as one?

You are sharing inaccurate and misleading information...

@SMMnet - One thing I am curious about, what are you exactly going to do as soon as Perkins Coie is sending you a cease and desist warning, protecting the business and interests of Facebook and Instagram?

People just trying to attack you without knowing your business. It's really crazy to me. Already in this thread they act like they know 1) Your budget 2) Your traffic 3) Your copyright rights. I guess some of these guys are competitors of yours and some are just jealous.

Why would they link to one of their competitor sites who is stealing their content? Why are you calling him a liar? The information he is sharing is logical.

If you are so concerned with rules and proper etiquette please dont forget to post one reply, you could have edited that info into the old post as you still had time instead of making a new post. Shall we go through your posts and @mickyfu posts and see who has contributed the most to the forum? Have you gone through all the shite and pointless posts the OP made, granted seems like he is getting on the right side of the tracks now but it was not always the case. Glad you are sticking up for things you believe in though, keep on keeping on. I'm glad the OP is an active member and hope he takes the advice of several members that tried to ease his transition into this community.

This OP was meant to update those concerned, the users you are support above have been nothing but trolling on my posts since I started.. Oh well.

One of my clients lost a DMCA complaint because they had previously shared product photos on Imgur.

I am not armchair lawyering here, I am referencing settled cases that I was personally involved with.
You are sharing inaccurate and misleading information...
So that makes it OK to call differing opinions a "fight"? That makes it OK to constantly treat me as your enemy?

And why do you think that is, you seem to remember everything but what you did and what EVERYONE tried to point out to you. I am not here trolling, I'm here just pointing out the facts. I wish you all the best and have nothing against you personally, but you dont seem to take advice from anyone and seem to just disregard anyone who tried to help you. I wish you luck with your copywrite issues, they suck when they happen and it just causes extra work.

So it worked for you too?? That's great new, congrats to that.

How long did it take after submitting your case?

Once you'll prove that you really own that content it won't take more than a few days! It took about 3 days (max).

How do you take advice when 90% of it is negative.

That's perfect. I submitted everything and the hosting company already contacted the site owner. Amazing.

I am not going to go back and edit an old post to a reply to a completely separate post, because when someone else wants to quote my post, then they also have to edit the quote in order to only quote the relevant portion of the reply. Multiple separate replies are a problem when 1) They are used to bump sales threads. 2) They are used to inflate post counts. There is a clear and legitimate reason for me to post multiple separate replies, and this is the lounge.

Even worse what is going to happen when the New York AG and the Florida AG launch a criminal investigation into him for fraud.

here I am, one page later, still wondering why his images are hosted on Imgur and not his own domain/cdn.
Why do I need a CDN if my speed time is already fast? CDN's are mainly used to speed a site up. Good recommendation though!

Pay the $50k and move on... But there is no fraud here.

Fair enough I should have noticed it was in the lounge. but they would not need to do that by the way, you could have added an extra quote in you could have done it easy. Granted this is the lounge, but I think the point i was trying to make with my post was clear. I won't waste anytime bumping the OP's thread, all the best ;)
