Just got this notice from hostgator:

We have received what appears to be a valid DMCA complaint, involving domains under your control. Please note that Hostgator has only passed on the validity of the Claimant's notice 17 U.S.C. Sec. 512 and has not sought to determine whether the Infringing Materials on the Web Site do indeed infringe upon the Claimant's intellectual property rights. We therefore strongly recommend that you immediately remove the Infringing Materials.

You are required to contact us within the next 48 hours with either a counter-notification, or the steps you have/will take to remedy this situation. If a response has not been received within a 48 hour period, we will be forced to disable this material in accordance with federal DMCA laws. A copy of the original DMCA notice is listed below our contact information.

Under the Digital Millennium Copyright Act, you have the right to file a "counter-notice" claiming that either (a) that the Claimant is wrong and that the Infringing Material is lawfully posted on the Web Site or (b) that the Infringing Material has been misidentified. We encourage you to review the procedures for filing a counter-notice, and to use this online form at http://www.chillingeffects.org/dmca to create a counter-notice with all the required elements. If you need any further information on how to file a counter notice, please let us know and we will be happy to assist you.
Can I move this site elsewhere to a different hosting where this company can't do anything about it?

just move it offshore if its worth it. if its something small then would just remove it and be done with it

I'm making like around $30-50/day with it.

How much does offshore hosting cost? This is the only site I need offshore hosting with

I just looked at Hive Hosting which is offshore and they don't allow sites that violate the DMCA

Hostgator must have got a threatening letter from someone. In my experience the web hosting companies will comply with these ASAP without really looking into the situation because they don't want to have to defend against a law suit (even if the law suit's basis is complete crap). Jump ship to offshore!

Hi,

I received the same some time back due to the fact that my wordpress blog got hacked and the hacker for some unknown reason copied some text from a similar to mine. They complained to my hosting company and they suggested that I take my website down until all the offending text was removed - I would not have minded by the text copied and pasted was rather lame and the owner of the other site should have been glad that it ended up on my website:)

If you do not want this to happen again as suggested host in a country who does give a damn.
