I hope y'all doing well. I wanted to write a bit and express my notions on DMCAs, bulletproof hosting companies as well as what is waiting for us in the future. While there appears to be some countries that are able to ignore DMCA requests to some extent, I believe a more sustainable "win-win" approach should take place between the "bullet proof" hoster and the user. As well as new techniques or services for getting traffic and being indexed in the search engines in the long run.
Definition of essence of DMCA first. A digital millennium copyright act is an act that was enacted in order to protect rights of IP (Intellectual Property) owners and prevent mediums from being spread in various forms illegally, nowadays that's mostly piracy websites and torrent trackers. DMCA is mostly the same thing as any IP right enforcement requests in other countries, be it Moldova, Luxembourg, or Russia. It works everywhere, it's just that it may be challenging sometimes to file the mentioned report. It would be beneficial to clarify there is no such thing as "bulletproof" or "DMCA ignored" hosting, all companies are legally required to act upon such requests, sometimes the takedowns happen hastily, for example you host pirated content on AWS, and sometimes it happens much later, examples are Alexhost or Hostgnome.
The question then appears to be on how to host illegal content for as long as possible. I believe to do that and still stay in the AWS level "legal" area, companies and users need to cooperate to take down the most pressing of the IP infringing take down notices and ignore insignificant rest that are coming from individuals and some organizations. Assuming that works, we have another problem of all kinds of people and entities reporting our web pages to search engines and consecutively search engines deindexing them. Or DMCA notices directed to payment gateways, who will readily decide to stop working with you. Thus, even if you achieve a way to ignore majority of the DMCA requests, you will not be able to control or influence other factors such as payment gateways and search engine indexing.
Given all that has been written so far, it's not all nice and bright. One of the solutions that may work is to have tones of other indexed links on different domains leading to your website. Mostly up to you, not sure what else we can do, you can suggest it below though.
