my emd has a brand name in it. i have two questions

is it a requirement for google to have disclaimer or can i create my site without it?

have you experience any consequences on your sites that has no disclaimer?

From what I know, no disclaimer is needed as long as you don't post as the company or brand name you have in your EMD. As far as I know worst they can do is issue a C&D.

What I did was place a page with DMCA information on it together with a disclaimer that the site is not owned by the brand that I'm promoting. Just playing safe.

Just by using the brand name in your emd is considered trademark infringement. No amount of disclaimers will protect you from that. It all depends on whether the company bothers to pursue it or not.
