Counter Sue on Stealth Account?

Hi,

As many of you VERO sellers know, eBay gives you an option to file a counter sue against the VERO party that got your listing taken down. Then eBay gives that party 10 business days to comeback with a response. If they do come back with a response, they are effectively suing you and you 'must' appear in court.

The court thing is bs as no judge is going to extradite you based on a civil matter (innocent until proven guilty). However, I still would not do it as the company will be all over you until they are satisfied you are not selling their goods anywhere on the internet.

What if you file this notice under a stealth account? How could they ever find out who you really are? Has anyone counter sued and won in general (no response etc?)

This is an administrative thing by eBay, not legal

If they do come back with a response, they are effectively suing you and you 'must' appear in court.

There is no such thing as "effectively" suing you. They either sue you legally or they don't.

1. The standard to appear in a civil court is actually lower in civil than criminal courts, since there is no right to not self incriminate yourself in a civil court.

2. Innocent until proven guilty only works in criminal courts, as civil courts work on preponderance of evidence.

Not anywhere on internet, just on eBay. You agreed to abide by VERO when you signed up on eBay, not anywhere else.

there is no such thing as a true "stealth"
if someone really wants to get to the bottom of this and know who is selling counterfeits, they certainly can.
