I uploaded a brand new song onto youtube right after it was released two days ago and I was the first person on all of youtube to upload the song. Then within the next hour there were about 100 other people who uploaded the song. It was a long anticipated song and the people who are ranked as "New" right now have gotten 500k views in 2 days. Both of whom I believe stole the video I made. I don't care that they actually stole the video from me. But its the fact that if I do mark them as copyright, it will give me thousands of more views and potentially rank me first or a lot better.

Heres my question: Has anyone marked someone else's video as copyright? What if I mark them as copyright for using my video I created, but the music on the video is not mine? Is there any legal issues if I do this?

If you're referring to Flagging the Video, that was something that I've done before back in the day.

I think as long as you Credit the Source, YouTube may unlikely take it down. You won't be faced with any Legal Issues because if YouTube suspects you of putting up CopyRighted Content, they will just reject your Video.
