Copying competitor links - what if they spam?

Low comp market... Rank 1 competitor has 10 forum profile links ALL with slightly* varied anchor text, and No Full URL links.

We are both competing with a subpage.

I've already copied a few of his profiles, but used full URL instead to avoid Penguin.

What's the right choice here? Copy his spam links and spam anchors? Or just copy his link locations with Post-Penguin style anchors?

I'll take a guess - don't copy the dumbasses spam anchors and just grab his link sources and do the proper variation. Cool I'm doing that we'll see what happens
 
start from the biggest page rank links first and check them manually one by one.

usually if they can leave a comment on a high pr blog that needs to be tested chances are that they dont spam.
 
Copy his links with post-penguin safe anchors. If rankings don't improve, then change the URLs to be anchor rich.
