content locking copyright file

I found a hot keyword with basically no competition, when i search for it in google I do see some info on DMCA complaints.
What im wondering is if I can SEO a site to be top for this keyword and then either have them download a fake version of the file, or upload it to a different site (out of the US) will I be safe?

If your asking, then probably not. If your willing to risk it then be prepared to take it down when you get nasty letters for lawyers.
