This is my first time doing foreign SEO and was wondering if I just took some niche related articles in English (already published) and translated them into my target language, could I then use them for backlinking purposes without risking a duplicate content penalty?
 
What you've suggested is quite a common approach to generate 'unique' content for free.

It certainly won't be duplicate content, but it won't be particularly high quality either.
 
Google translate is your friend, so revive all those old PLRs :)

May be merge the translated articles to one and try to use that for seo purpose..
you will be on the safer side..
 
Google will not filter your content as a duplicate but in case you are just doing program translation without final proofreading you content will not get any trust. Google understands this method but does not give real penalties for using it.
