If mails are autorized by owners by mailing list form or similar. If not you can simply send a mail to ask autorizzation to receive commercial mail (grey hat because you can't contact in any way this mails). If you don't do this is 100% illegal.

If emails sends to the subscribers want to receive the email by you then it is not spam. Emails send to the people without their permission is definitely called spam activity.

its not easy to confidently say if it is spam or notbut it is depend upon the content of ur email thet u send...

With the new anti spam law for emails. You need the users consent for commercial emails/subscriptions

If the email recipients had previously opted-in to receive further information or offers from you or your business through a lead capture or landing page, then commercial email marketing can be fine in that case. Keep in mind to make sure you are not violating any do not contact registry lists and you promptly address unsubscribe requests.
