Yeah cuz he lives in Germany and I live in a country next to it. True, I might actually trademark it eventually.
The thing is that the name I want seems to be trademarked, but only in Spain since 1990 and some trademark checkers say it's not valid anymore but others just say "status active". Weird

Both blue names. One definitely more genuine than the other one cuz the team seems to be doxxed but that also results in the price to be high asf.
 
So as of right now I've sent a DM to the account owner that I'm interested in buying his account.
Also sent a DM to 3 other accounts that might still have contact with him.

The account I used to DM them is an old big account 100K+ (private) in order to increase the chances a response.
Guess after all the DM's I might still send + playing the waiting game. I might eventually go to the 2nd option which is trademarking the name and then contacting IG.

So, I've been able to track down the owner of the account which has the username I want with the help of one of his friends (I've DM'd a lot of people I thought were friends of him)

Long story short, it's really hard to get in contact with this guy. He accepted my follow request on his current account but still hasn't answered my DM's.
His friend told me he didn't have contact with him on IG as he also didn't get any responses, he also changed his phone number so his friend can't call his phone number.
Apparently he moved for study reasons, otherwise it wouldn't have been an issue for his friend to go talk to him irl as he knows where he lived.

I don't know, it's not looking too good but I still have some cards to play.

If you have a name trademarked, you can submit your proof of TM from a business email related to that TM.





For example if you want the name @https://www.blackhatworld.com/members/93212/, you would need to register Florida as a trademark in a juridiction that doesn't have it registered.





Create a fake threadmark





Then reach out to FB saying you have found an account that infringes upon your copyright. Then you request to take the account and they follow up with you via email.

You must reply to them from an official email linked to the trademark holder. (Law firm representing you is best)





The account should be inactive (no posts) within at least 1 year.

That has no sense at all
Disabled accounts still exist, and their usernames still linked to them

I don't know if you know it, but there are more black hat ways to get usernames from disabled accs / inactive accounts with some help of insiders.

I have been offered it by a guy I used to be friend with, connected to a big music company, I've never tried it, so I won't recommend it.

You can apply for the EU-wide trademark which is enforceable across the whole union from the get-go there's no need to register a trademark on the local level first. This, however, will cost you 850 EUR while local registration can cost just a third of that amount. There's no need to hire a lawyer for this (this advice applies strictly for EU trademarks) you can submit the application yourself right here.

Now, whether this will work with Instagram is a good question. Owning a trademark is not the same as enforcing a trademark, you will, in many cases, have to fight for your trademark rights to be respected. What is a fake brand in your understanding? You can register a trademark and then not use it. (Once again, what I write applies to EU only). Nobody will ask you to prove that you are using or intend to use the trademark, the registration fee itself is the sign of intent. However, owning a trademark is not the same as owning a patent. You will not be able to successfully argue that someone used your trademark if you aren't extensively using it yourself. Now I am no lawyer and I've studied only my local trademark law for a short period of time but from my understanding the court will not rule in your favour simply because you are the owner of the name, you will have to prove that the infringing party is using the name in a way that harms your trademark and if you had not used your trademark ever then there was no harm done.

Can you search us for the matter and extract the way to claim username on an unused account for more than 5 years on Instagram? We need this order.

Yes, I was able to get an answer from the owner of the inactive account which holds the username I desire.
However, it wasn't a good answer. He simply told me that he's not interested in selling me his account.
I quickly replied that I didn't want his whole account but only his username, so I asked if he could just change the username of that account.

He just always left me on read after his first and last response. Nothing worked, not even money. Idk, he's very stubborn and just wants to hold his inactive account while he clearly has a new personal one (which is how I was contacting him).

Thanks for the direct links! I feel like a good chunk of luck is always involved when it comes to using the trademark strategy with Instagram depending on who's handling the case.
Either way, I might trademark it nonetheless later down the road. Because it's just like you said, it might be a good move in general.

My friend, report it using the link and adopt it. I heard that if you want to get the username, swear it through the rights link
 
You are trying to get the IG Deymon - That's just one photo of some guy posing with his friends.

I don't see how you can convince IG that it's infringing on your Trademark even if you register a Trademark.
If you Trademark that name for a particular business / service,
he should be misusing the account to be misleading someone into thinking of it as your legit service.
