CAN-SPAM and Email

I have a few questions I hope some of you can answer.

I wrote a few letters to businesses and I'd like to follow up via email to those that haven't responded.
Can I legally do this, or is it a requirement that they must opt-in?

Also, if a business holds a drawing and collects emails that way, can they opt them into a newsletter without violating CAN-SPAM?
