Be sure to move to an offshore webhost so they can't complain to your current webhost to shut down your site due to DMCA violations.
And make sure to spin the content to over 50% unique if your site requires high rankings on Google.

There's a tool called WP Twin. It'd do what you want done. Not sure If it's free or not, you might want to check that out.

Yep, as above, WPTwin needs pretty much root access from what I understand - something I don't think you have when it comes to your competitors site.
However, I might be the only one given it is BHW, but I don't think it would be completely fair for you to just copy their website and use it as your own, considering they have done work to get it to where it is. Shoot me if you will, but I don't think that is the right thing to do. Either way, I don't believe it is possible to be honest - you can manually just copy down all of their content and stuff, since you already have the theme with you, but obviously this is going to take a bit more time.
I guess if it was worth cloning, it would probably be worth manually making it too!
