I registered a domain on namecheap and i am using an offshore host. I'm not hosting any illegal stuff, but the site may contain malware. (not a botnet)
Now i just read that DMCA can take down domains if bought from US companies? Is this true?
If so am i safe if i transfer the domain to an offshore registrar?

A DMCA would normally take down the hosting, unless the domain name itself violated copyright laws. It's most likely that a domain would violate trademark laws though.

DMCA is an Act not an Association. The content taking down is done by DMCA service websites. I don't think they can touch your domain. And as far as content takedowns are concerned, a DMCA ignoring host will take care of that.
Offshore hosts are a nightmare for these DMCA service websites.

If a domain get's taken down is it still usable on a another host?

DMCA can't take down domains,
but USA seized some domains in 2011 & 2012

like:
MegaUpload
FileSonic

you must have 2 domain
1) top level
2) Netherland or Sweden

when USA seized your first domain, you can forward your traffic to other domains
like ThePirateBay
