Sending spam reports via WMT is so yesterday. These days they just link bomb your site into oblivion for faster results.

Yes a competitor can. They research your links, create a text file with them, search for your term, use the feedback button on the bottom of each search page, and report for TOS violations. No need for the spam report form.
