I have done this and in my experience you won't get banned for placing a link unit like this. Probably because onece the surfer clicks on the link unit he will be taken to a page with Google ads where he needs to click again to generate adsense income.
However placing an ad unit in a similar fashion might be a different story.
Actually, you can hide ads inside menus as well as break most of other TOS... if you are a premium adsense publisher (you need 20 million pageviews/month to apply for a premium acc).
Even though his ads might seem a bit misleading and like a menu, it is link-ads. Which means that they dont count as a click first time you click it. It will just lead to a new page, where google serve a bunch of ads with text, and only when somebody click one if these you get paid.
Therefore there wont be a lot of misleading clicks, majority of people know how to use the "back button" if they feel the overview page from google is not interesting.
if it wasn't for me, you'd be dumb forever while giving people false information.
Anyway, the ads are fine. I bet he lowered his ctr just because the website is in a public forum. I also bet, some ahole will purposely click his ads to get him banned. Let's see what happens.
I think it is really a great links placement. I'm now going to create some sites for adsense and this is a wonderful idea for links placement, it would be interesting to know what theme is this guy using. And also I wonder what is better with such links placement - to have one or several accounts for several sites - so that they all don't get banned at a time? Does anyone has such experience?
