Google earns money on the clicks too, so unless somebody files a complaint about fraud or misleading clicks etc., they most likely wont shut you down even if you do not live up to their TOS. As long as its a minor issue, you may just get a warning from G , so I believe its worth the risk for most websites.

btw i just checked i knew i was right in some way although his may not be all for content type ads, ppl like you annoy me with stupid remarks..... Currently, AdSense publishers may place up to three AdSense for content units on one webpage.
so "facepalm" yourself :/

You get 3 text ads however, you can place more than 3 if the additional are link box ads
yea i read the ToS properly and seen that, but good on you for giving a proper answer unlike the muppet above

i seen other websites with much more misleading ad placements. I never thought about strategically placing adsense though . it seems like its almost a 50/50 on if this is legal or not. to be on the safe side , i prolly will not change my adsense.

Ok.... Just got it to load. Guess the site had a lot of traffic from everyone here.
Ummm.... ads in the header are a pretty much no-no. Yes the "Ads by Google" is there but it is in a zone that's not allowed.
If one is to believe his footer copyright notice then he's been doing this probably for a good while now. However I think that person is playing with fire.
All that said, if big G spanks him there are several other opportunities that could be explored with that ad space.

Damn... Don't know why this intrigues me so much but it does. First off the site has an ad block ABOVE the main site page. The webmaster here is using psychology in the ad placements.
The users eyes go from the very top to the right in the header where the logo is. Then left to the ads, Then down center, and once again to the left.
If I didn't know better I would swear this is a guy I know with a PHD in psychology that does marketing.
