Hi Artizhay, thanks for dropping by, but if I was fighting fire with fire, it would be not paying them for something they did for me, which didn't happen.
I plan on using internet marketing tactics and other internet resources to fight a breach of contract.
However, the BBB is a good idea, although it didn't help much a while back when a dealership screwed us, they just denied what really was said.

Monetizing it is the least of my concern. How do I avoid that claim in the first place? Any ideas?

Definitely don't do anything to monetize it. That'll make things worse. As long as you post facts and have evidence to prove your facts, you can still get a claim filed against you, your chances of winning it should be good though.
If you have to do anything, maybe don't use the company name in the domain.

My honest thoughts are that if you do in fact set up such a site, that they'll hit you with a defamation lawsuit and try to bankrupt you as many times as they can. I do not think you should tinkle in their morning breakfast (if you get my drift).

As long as you do not monetize such a domain you actually have the fair use right to have another company's trademark in it. See http://www.wipo.int/amc/en/domains/decisions/html/2000/d2000-1015.html and other decisions.
