Avoiding lawsuits / Branding Copyrights

Hey, I recently received some work from a local photographer asking me to build him a website.

I have seen some warnings given out by people to stay away from branding issues, the problem is that he wants the website to be named something along the lines of Rjstudios.uk (Using faking domain name as example)

Unfortunatelytheir is already another website under the name of Rjstudios.com which is in a totally unrelated field (construction and development), can my client and I get in legal trouble for using that domain name?

If so how can I tell what has already been branded and what has not?
 
i don't see how, if your business is unrelated and your site looks nothing like theirs then it should be ok. Branding only stops similar products or services, as you are unrelated then ok

Really? I guess that I would have never known that.
 
Your should have to provide more details then it would easy for me to provide good suggestion. However, you shouldn't conduct this action and you should also observe the cyber laws on this issue.
